PRIVACY POLICY

1. Introduction

Hazlo LLC ("Company", "we", or "us") respects your privacy and is committed to protecting it through our compliance with this privacy policy (the "Privacy Policy"). This Privacy Policy describes our practices in connection with the types of information we may collect from you or that you may provide, and our practices for collecting, using, maintaining, protecting, and disclosing that information, when you visit the Platform.

By using the Platform, you confirm that you have read and understood this Privacy Policy, together with our Terms of Service (collectively referred to herein as the "Agreement"). The Agreement governs the use of the Platform. All capitalized terms used in this Privacy Policy, unless otherwise defined, have the meanings ascribed to them in the Terms of Service. However, for the sake of clarity, use of the "Platform" refers to the use of Hazlo's website: www.hazlosports.com as well as its mobile application: HAZLO.

This Privacy Policy applies to information we collect:

  • On the Platform;
  • On Company social media pages controlled by us (each a "Social Media Page" and collectively, our "Social Media Pages");
  • In email, text, and/or other electronic messages between us and you; and,
  • When you interact with our advertising and applications on third-party websites and the Platform, if those applications or advertisements include links to the Platform.

The data controller of your personal information is Hazlo LLC for the website accessible from: www.hazlosports.com. The Company will use your information as further explained in this Privacy Policy.

Please read this Privacy Policy carefully to understand the Company's policies and practices regarding your information and how we collect, process, and store it. If you do not agree with the terms of this Privacy Policy, your choice is to not use our Platform. This Privacy Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Platform after we make changes to this Privacy Policy is deemed to be an acknowledgment and acceptance (unless affirmative opt-in consent is otherwise required by applicable law) of those changes, so please check this Privacy Policy periodically for updates.

2. Children Under the Age of 13

Our Platform is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13 years of age. If you are under 13 years of age, do not use or provide any information on our Platform or through any of its features, register for accounts on the Platform, make any purchases through the Platform, use any of the interactive or public comment features of the Platform, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a person under 13 years of age without verification of parental consent, we will delete that information. 3. Information We Collect About You and How We Collect It

We collect several types of information from and about Users of our Platform, including information:

  • By which you may be personally identified, such as name, address, email address, telephone number, date of birth, copies of formal identity documents such as your passport or ID card, or credit or debit card details ("personal information");
  • That is about you but individually does not identify you; and/or
  • About your internet connection, the equipment you use to access our Platform, and usage details.

We collect this information:

  • Directly from you when you provide it to us;
  • Automatically as you navigate the Platform (such as usage details, IP addresses, and information collected through web beacons and other tracking technologies); and/or
  • From third parties (such as our business and service partners).

(a) Information You Provide to Us

The information we collect on or through our Platform may include:

  • Contact Information – Such as your first and last name, physical address, telephone number, and email address, which is needed to set up your account.
  • Billing Information – Such as your credit or debit card number, expiration date, security code, and zip code, as necessary to process your payments.
  • Identity Information – Such as your date of birth, address, and, depending on where you reside, your social security number, tax ID number, VAT ID number, or social insurance number (if applicable), photos of your ID document (e.g., passport, local ID, or driver's license), together with the result of basic criminal record checks as provided by you or by our Third-Party Agents, as applicable and to the extent permitted by law in your jurisdiction, as well as such information as may be needed to validate your identity.
  • Financial Information – Such as bank routing numbers, tax information, taxpayer identification number, and other payment information, as applicable to operate the Platform and to ensure that Coaches are paid by Community Members.
  • Booking Information – Such as information about the Service you are seeking (e.g., the time, date, and location). If you are a Coach, we also collect information about your Service(s), rates, and skills.
  • Professional Experience Information – Such as employment and education history, certifications, training, and any responses to custom questions describing your professional experience.
  • Content Information – Such as information submitted via email or chat messages between you and us or between you and other Users, including photos shared between Users or by a Coach related to the performance of a Service.
  • Third Party Information – Such as demographic data, financial information, or fraud detection information from Third-Party Agents to comply with our legal obligations, and for the legitimate interest in improving the Platform.

(b) Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Platform, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including, but not limited to:

  • Service Use Data – Such as data about features you use, pages you visit, emails and advertisements you view, portions of the Platform that you view and interact with, the time of day you browse, and your referring and exiting pages.
  • Device Data – Such as data about the type of device or browser you use, your device's operating system, your internet service provider, your device's regional and language settings, and device identifiers, such as your IP addresses.
  • Location Data – Such as imprecise location data (e.g., location derived from an IP address or data that indicates a city or postal code level), and, with your consent, precise location data (such as latitude/longitude data).

The information we collect automatically does include personal information, but we may maintain it or associate it with personal information we collect in other ways or that we receive from third parties. We need to collect personal information from you because it helps us to improve our Platform and to deliver a better and more personalized services, including by, but not necessarily limited to, enabling us to:

  • Estimate our audience size and usage patterns;
  • Store information about your preferences, allowing us to customize our services or Platform according to your individual interests;
  • Speed up your searches; and/or
  • Recognize you when you return to our Platform.

The technologies we use for this automatic data collection may include:

  • Web Beacons. Pages of our Platform may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

(c) Information We Receive From Other Sources

We work closely with third parties including, for example, our payment service providers ("PSP") and email address and telephone number verification service providers. Specifically, in providing services to you, the Platform incorporates service solutions provided by third-party service providers such as, but not limited to, Stripe and/or Supabase. We may receive information about you from these and other third parties to verify information you provide to us which helps us to identify suspicious or unusual transactions.

We may also supplement the information we collect with information from other sources, such as publicly available information about your online and offline activity from social media platforms, advertisers, commercially available sources, and information from our affiliates, subsidiaries, and/or business partners.

We allow you to share information with our Social Media Pages or use social media sites to create your account on the Service Platform or to connect your account with the respective social media site. If you connect your social media account to your Platform account, you will share certain personal information from your social media account with us. For example, you will share your name, email address, photos, list of social media contacts, and any other information that may be or you make accessible to us when you connect your social media account to your Platform account.

We may also use plug-ins or other technologies from various social media sites. If you click on a link provided via a social media plug in, you are voluntarily establishing a connection with that respective social media site.

4. Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications, including advertisements, on the Platform are provided by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Platform. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. For information about how you can opt out of receiving targeted advertising from many providers, see Choices About How we Use and Disclose Your Information.

If you disclose any personal information relating to other people, to us, or to our service providers in connection with the Platform, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

5. How we Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

(a) Functionality of the Platform

  • To provide our Platform and their contents to you, such as arranging access to your Platform accounts, enabling you to purchase or fulfill Service(s), managing your relationship with us, or customer service.
  • To connect you with other Users to fulfill a Service.
  • To conduct identification and criminal background checks, to the extent permitted by law.
  • To ensure the safety of our Users both online and offline.
  • To respond to your inquiries, and provide you with information, products, or services that you request from us.
  • To complete your transactions, verify your information, and provide you with related benefits or customer service.
  • To provide you with notices about your account, including changes to our terms, conditions, or policies.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To provide you with customer support and to assist in resolving Users' complaints.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

We will engage in these activities to manage our contractual relationship with you and/or to comply with a legal obligation.

(b) Communicating with You

  • To send you marketing related emails, with information about our Platform and other news about us.
  • To communicate with you by telephone, mail, email, text (SMS) message, instant messaging, or other electronic means, consistent with applicable law. Message and data rates may apply.
  • For any other purpose with your consent.

We will engage in these activities with your consent or where we have a legitimate interest.

(c) Administration of Contracts

  • To open, manage, and terminate the contractual relationship.
  • To enforce legal claims arising from contracts (debt collection, legal proceedings, etc.).

We will engage in these activities to manage our contractual relationships, comply with a legal obligation, and/or based on our legitimate interest.

(d) Analyzing Personal Information

  • To analyze our Users' preferences so we can improve our Platform.
  • To better understand your interests and preferences, so we can personalize our interactions with you, provide you with information tailored to your interests, and deliver content via our Platform that we believe will be relevant and interesting to you.

We may provide personalized services based on our legitimate interests, and with your consent to the extent required by applicable law.

(e) Aggregating and/or Anonymizing Personal Information

We may aggregate and/or anonymize personal information so that it will no longer be considered personal information to generate other data for our use, which we may use and disclose for any purpose, as it no longer identifies you or any other individual.

(f) Accomplishing Our Business Purposes

  • For audits to verify that our internal processes function as intended and to address legal, regulatory, or contractual requirements.
  • For fraud prevention and detection and fraud security monitoring purposes.
  • For training and quality purposes and for the purpose of investigating any complaint you may make, or as evidence in any dispute or anticipated disputes between you and us.
  • For developing new products or services, or enhancing, improving, repairing, or modifying our current products or services.
  • For operating and expanding our business activities – for example, understanding which parts of our Platform are of most interest to Users so we can focus on meeting our Users' interests.

We engage in these activities to manage our contractual relationship with you, to comply with a legal obligation, and/or based on our legitimate interest.

We may also use your information to contact you about our own and third parties' goods and services that may be of interest to you. If you do not want us to use your information in this way, please adjust your user preferences in your account profile. 6. How We Disclose Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect, or you provide as described in this Privacy Policy to the types of third parties described below, in connection with the provision of services or as otherwise permitted or required by law. For example, we may disclose information about you to:

  • To our subsidiaries and affiliates.
  • To share one User's contact information (e.g., name, phone number, email, or postal address) with other Users, or with the recipient User's legal or other authorized representative, in order to: (i) facilitate or communicate the resolution of an investigation or dispute related to or arising from an interaction between two or more Users of the Platform; or (ii) facilitate the performance of a Service. This exchange of information is essential to the operation of the Platform.
  • To contractors, service providers, and other third parties we use to support our business and facilitate services they provide to us, such as website hosting, data analysis, payment processing, order fulfillment, fraud prevention, customer service, email delivery, auditing, and other services.
  • Our business partners, financial institutions, and credit agencies, consistent with applicable law.
  • To third parties to market the Platform, or such third-party products or services, to you if you have not opted out of these disclosures.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our terms and conditions and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect our rights, property, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our users is among the assets transferred.

7. How Long Do We Keep Your Information?

We will retain your personal information for as long as needed or permitted in light of the purpose(s) for which it was obtained. The criteria used to determine our retention periods include: (i) the length of time we have an ongoing relationship with you and provide services to you; (ii) whether there is a legal obligation to which we are subject; and (iii) whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations).

Please note, however, that this is not an exhaustive list of retention periods. Your personal information may be stored for a longer period using the criteria set forth in the first paragraph of this section, especially points (ii) and (iii).

8. Your Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by logging into the Platform and adjusting your user preferences in your account profile, or by sending us an email with your request to contact@hazlosports.com.
  • Promotional Offers from the Company. If you do not wish to have your contact information used by the Company to promote our own or third parties' products or Platform, you can opt-out by logging into the Platform and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes, or by sending us an email stating your request to contact@hazlosports.com.
  • Marketing-Related Communications from the Company. If you no longer wish to receive marketing-related communications from us, you may opt-out by selecting the 'unsubscribe' option in the marketing communication we sent, by sending us a return email asking to be omitted from future email distributions, or by changing your account preferences. This opt-out election does not apply to information provided to the Company as a result of a Service purchase, warranty registration, Service experience, or other transaction.
  • Text (SMS) Messages from the Company. If you no longer wish to receive text (SMS) messages from us, you may reply STOP at any time to cancel these messages or opt out by contacting contact@hazlosports.com.
  • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by sending us an email stating your request to contact@hazlosports.com. For this opt-out to function, you must have your browser set to accept all browser cookies.

This Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating any website or service to which the Platform links. The inclusion of a third-party link on the Platform does not imply endorsement of the linked site or service by us or by our affiliates. Additionally, we are not responsible for the information collection, use, disclosure, or security policies or practices of other organizations, such as Facebook, Apple, Google, Microsoft, or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider, or device manufacturer, including with respect to any personal information you disclose to other organizations through or in connection with our Social Media Pages.

By consenting to this Privacy Policy, you are giving us permission to process your personal information specifically for the purposes identified. You may withdraw consent at any time by contacting us at contact@hazlosports.com.

Residents of certain countries and states may have additional personal information rights and choices. Please see Your State Privacy Rights for more information.

9. Accessing and Correcting Your Information

You can review and change your personal information by logging into the Platform and visiting your Platform account's profile page.

If you would like to request access to, correct, update, suppress, restrict, or delete any personal information that you have provided to us, object to or opt out of the processing of personal information, or if you would like to request to receive a copy of your personal information for purposes of transmitting it to another company (to the extent these rights are provided to you by applicable law), you may email us at contact@hazlosports.com. we will respond to your request consistent with applicable law. For example, we may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

In your request, please make clear what personal information you would like to have changed or whether you would like to have your personal information suppressed from our database. For your protection, we may only implement requests with respect to the personal information associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable.

Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion. For example, when you contract for a Service, you may not be able to change or delete the personal information provided until after the completion of such Service(s).

If you delete your User Generated Content from the Platform, copies of your User Generated Content may remain viewable in cached and archived pages or might have been copied or stored by other Users. Access and use of information contributed by you to our Platform, including User Generated Content, is governed by our Terms of Service.

10. Third Party Payment Service

For Users who use the Platform to submit personal financial information to purchase Services or be paid for providing Services, we utilize third-party payment providers to process all payments and tax-reporting documents on our behalf. When you provide certain personal information on the Platform, all such information is provided directly by you to our third-party payment processor partners. The payment processors' use of your personal information is governed by their respective privacy policies and or notices. We have no control over, and are not responsible for, Stripe's collection, use, and disclosure of your personal information.

11. Your Local Privacy Rights

Certain local laws as well as the laws of foreign jurisdictions, such as, without limitation, the European Union's General Data Protection Regulation (GDPR), Brazil's Lei Geral de Proteção de Dados (LGPD), and California's Consumer Privacy Act (CPRA), require the Platform to provide information about the information they collect, how they use it, and the lawful basis for processing it. You can find certain state and region-specific information and disclosures below.

As described above, all our users have control over their information and can directly edit or delete information from their account and limit what data we process. If you are located in certain regions, including the European Union, you may have additional rights such as those listed below:

  • The right of access to your personal information;
  • The right to rectify your personal information if it is incorrect;
  • The right to erase your personal information;
  • The right to limit the processing of your personal information;
  • The right to the portability of your personal information;
  • The right to object to the processing of your personal information;
  • The right to withdraw your consent; provided, however, that withdrawing consent does not affect the lawfulness of processing based on consent before withdrawal; and
  • The right to judicial review in the event that we refuse your request to exercise any of your rights.

(a) Information for Users in Certain U.S. States

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. If you are a resident of California, Colorado, Connecticut, Oregon, Texas, Utah, or Virginia, you have additional rights that you (or, in certain states as set forth below, an authorized agent acting on your behalf) can exercise through the Platform directly or by contacting us, including the right to:

  • Access and/or receive a copy of certain personal information we hold about you;
  • Correct your personal information;
  • Delete certain personal information we hold about you;
  • Receive information about the financial incentives that we offer to you, if any;
  • Opt-out of the processing your personal information for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects, if applicable; and
  • The right to judicial review in the event that we refuse your request to exercise any of your rights.

California and Oregon residents can also request information about the categories of personal information we collect, disclose or sell or share about you (each to the extent applicable).

California residents can request the categories of sources of such information; the business or commercial purpose for collecting or selling or sharing your personal information; and the categories of third parties to whom we disclose personal information (each to the extent applicable).

Oregon residents can request a list of the specific third parties, other than natural persons, to which personal information has been disclosed, if applicable.

You also have the right to not be discriminated against for exercising your rights. The laws of the states above also provide residents the right to opt out of "sales" of your information and "sharing/processing of information for targeted advertising."

Certain information may be exempt from the requests above under applicable law. For example, we need to retain certain information in order to provide our services to you. We also need to take reasonable steps to verify your identity before responding to a request. If you are an authorized agent submitting a request on a user's behalf (where permitted), we may require proof of your written authorization before processing the request. Residents of Colorado, Connecticut, Oregon, Texas, and Virginia have the right to appeal our decision to deny your request.

Please be sure to include your full name, email, address, and which type of request you are making in this letter.

(b) Additional Information for Users in California

In addition to the rights described above, consumers residing in California are afforded the right to certain additional information with respect to their personal information under the California Consumer Privacy Act of 2018 and California Privacy Rights Act of 2020 (collectively, the "CPRA"). If you are a California resident, this section applies to you.

Our collection and use of personal information: We collect the following categories of personal information: identifiers (such as your username, the email address you used to sign up, and your phone number if you've chosen to provide it); commercial information (a record of what you've bought from us, if anything); financial data (your history of purchases from us); internet or other network information (how you interact with the Platform); location information (because your IP address may indicate your general location); inference data about you (for example, what content you may be interested in); and other information that identifies or can be reasonably associated with you. For more information about what we collect and the sources of such collection, please see the Information we Collect About You and How we Collect It section of this Privacy Policy.

We collect personal information for the purposes described in the How We Use Your Information section of this Privacy Policy.

Disclosure of personal information: We may disclose your personal information to third parties as described in the How We Disclose Your Information section of this Privacy Policy. We disclose the categories of personal information mentioned in that section for business or commercial purposes.

No sale or "share" of personal information: The CPRA sets forth certain obligations for businesses that sell or "share" personal information. We do not sell or share the personal information of our users as those terms are defined in the CPRA. We do disclose certain information as outlined in the How We Disclose Your Information section of this Privacy Policy and you can make choices with respect to your information as outlined in this Privacy Policy.

We retain personal information as described in the How Long Do We Keep Your Information section of this Privacy Policy.

California's "Shine the Light" law gives residents of California the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal information (as defined in the Shine the Light law) with third parties, as defined under applicable law, for their direct marketing purposes.

(c) Information for Users in the EEA, United Kingdom, and Switzerland

All our users have control over their information and can directly edit or delete information from their account and limit what data we process. In addition to these rights, users residing in the European Economic Area (EEA), United Kingdom (UK), and Switzerland are afforded additional rights under the General Data Protection Regulation (GDPR), the UK Data Protection Act 2018, and the Swiss Federal Act on Data Protection (FADP). For example, you can request a copy of your data, ask to have it deleted, and adjust your privacy settings right in the Platform. If you are a resident of these regions, this section applies to you.

Data Controller: If you reside in the European Economic Area ("EEA") or United Kingdom, the "data controller" of your personal information collected by the Platform is as provided in this Privacy Policy.

Exercising your rights: All our users have control over their information and can directly edit or delete information from their account and limit what data we process. Users in the EEA, UK, or Switzerland have additional rights that you can exercise through our Platform directly or by contacting us. Those rights include:

  • The right of access to your personal information;
  • The right to rectify your personal information if it is incorrect;
  • The right to erase your personal information;
  • The right to limit the processing of your personal information;
  • The right to the portability of your personal information;
  • The right to object to the processing of your personal information; and,
  • The right to withdraw consent; provided, however, that withdrawing consent does not affect the lawfulness of processing based on consent before withdrawal.

12. Data Security

We seek to use reasonable organizational, technical, and administrative measures designed to protect personal information under our control. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. All information you provide to us is stored remotely by our third-party service partners involved in the collection of such information. Any payment transactions are encrypted using the SSL technology, if any, provided by our payment partners' payment platforms. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you have with us has been compromised), please immediately notify us in accordance with the Contact Information section below.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Platform. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Platform.

13. Changes to Our Privacy Policy

It is our policy to post any changes we make to our Privacy Policy on this page, which may be accompanied by email or other means of communication. If we make material changes to how we treat our Users' personal information, we will notify you by email to the primary email address specified in your account, and/or through a notice on the Platform. The date this Privacy Policy was last revised is identified at the bottom of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Platform and this Privacy Policy to check for any changes.

14. Contact Information
